A right of appeal to the General Division of the Administrative Appeals Tribunal (AAT) for a second review (tier two review) is available to parties (including Centrelink) who are dissatisfied with a first level review decision at the Social Services and Child Support Division of the Administrative Appeals Tribunal decision. The General Division of the Administrative Appeals Tribunal is a higher level tribunal and has the power to review first review decisions made by the Social Services and Child Support Division of the AAT.
To make an appeal to the AAT for a second review, an application must be lodged at the Administrative Appeals Tribunal registry within 28 days of the date that the AAT first review decision was received in writing. This is a strict time frame and only in special circumstances will an extension of time be granted [see Administrative Appeals Tribunal Act 1975 (Cth) s 37].
