Under the Planning, Development and Infrastructure Act 2016 (SA), a number of ‘relevant authorities’ are able to assess and make decisions about development applications. These ‘relevant authorities’ include:
- Minister for Planning
- State Planning Commission
- Assessment panels (includes a Council Assessment Panel, Joint Planning Board Assessment Panel, Local Assessment Panel etc.)
- Assessment managers
- Accredited professionals
- Councils

State Planning Commission
The State Planning Commission (SPC) is a special statutory body responsible for certain types of development or development in certain areas. The SPC is also the relevant authority if a local council is itself the developer or has a conflict of interest over the development. The Planning, Development and Infrastructure Act 2016 (SA) [see s 94] and Planning, Development and Infrastructure (General) Regulations 2017 (SA) [reg 23 and Schedule 6] set out the different circumstances in which the SPC is responsible for a particular development. The SPC is the relevant authority in relation to these proposed developments:
- most developments undertaken by the SA Housing Trust and the Urban Renewal Authority [Planning, Development and Infrastructure (General) Regulations 2017 (SA) Sch 6, cl 1(1)]
- mining operations (excluding construction or excavation of borrow pits) [Sch 6, cl 1(2)]
- some classes of development within the Adelaide Park Lands [Sch 6, cl 2]
- developments within the City of Adelaide area, where the development cost is over $10 million [Sch 6, cl 3]
- developments where buildings exceed 4 storeys [Sch 6, cl 4]
- developments in an identified area within the City of Port Adelaide Enfield, where the development cost is over $3 million [Sch 6, cl 5]
Where the State Planning Commission is the relevant authority and the proposal involves building work, the SPC can refer the building aspects of the assessment to the council or a building certifier [Planning, Development and Infrastructure Act 2016 (SA) s 99(1)].
