Statements of rights, and reasons for Guardianship Board decisions
Where the Guardianship Board makes an order under the Mental Health Act 1993 the Board must give the patient a statement under s29 of:

the effect of the decision or order
-
the rights of the patient to appeal
-
how to commence an appeal.
Where the patient, the applicant for an order, the treating professionals, the Public Advocate or any person with a proper interest believes that the Board has made the wrong decision they have a right to require the Board to provide a written Statement of Reasons for the decision. The application for a Statement of Reasons should be made as soon as possible, but can be made within three months of the decision.
