Spousal maintenance

Unlike a married person, unmarried partners cannot claim maintenance for themselves from the other. Married persons can make claims for spousal maintenance under the Family Law Act 1975 (Cth). De facto partners in South Australia, unlike other States, are not covered by the Family Law Act but by State legislation (the Domestic Partners Property Act 1996), which does not provide for spousal maintenance.
