It is not generally a defence to have been intoxicated by alcohol or drugs at the time of committing an offence. It is a defence if it can be shown that, as a result of intoxication or drug use, the defendant did not have the mental awareness or intention required by law for the commission of the offence. This is a very complicated defence and should not be used without legal advice.
