WORKERS COMPENSATION

Most injured workers are eligible for compensation under the Workers Rehabilitation and Compensation Act 1986 . That Act makes the Workers' Rehabilitation and Compensation Corporation (known as WorkCover) liable to pay compensation to a worker who has sustained an injury arising out of or in the course of her or his employment.

Workers who are disabled at work may be entitled to payment of:

  • expenses incurred as a result of that injury (such as medical and hospital)
  • weekly payments of compensation. A worker who has not been permanently incapacitated for work may still be entitled to compensation if they are incapacitated for work for a period of time because of that injury
  • compensation for any permanent, physical disability caused by the injury. The amount of compensation will depend on the extent to which the worker has been disabled, see Lump Sum Payments.

These payments are also available to a worker who catches a disease at work. Depending on the effect of the disability a worker may be entitled to all three types of payments.
